A Quit Claim Deed served to transfer all of your mother's ownership interest to your brother when the deed was delivered to him. Many times Wills don't serve to transfer any asset at all since gifts of property are made during the decedent's life time which apparently happen with your mom.
I have worked with people who received very substantial gifts from their parents and upon their parent death gave/shared that property with their siblings. Most of the time however, no post death sharing takes place.My mother died and the will says all split 3 ways, house, all but she also signed a quit claim deed to brother?
The way I understand the law, the house belongs to your brother. However, don't take it from me. That's what lawyers are for.
